Prosecutor Seeks Ten-Year Sentence for Alleged Sexual Assault
The Malaga public prosecutor’s office is pushing for a ten-year prison term for the accused in a sexual assault case involving penetration. The incident reportedly occurred during a business trip to Benahavís, where the victim was allegedly raped by a colleague while she was asleep, having taken a sleeping pill.
Details of the Incident
The incident took place in the summer of 2021 when several employees from a company located in a different Spanish province were staying at a rented apartment complex in Benahavís, near Marbella. The group included the victim and the accused. The prosecutor’s office in Marbella alleges that the accused, a 36-year-old man, entered the room where his colleague was sleeping in the early hours of July 11.
Alleged Assault
The accused reportedly knew that the woman had taken a sleeping pill, a fact he exploited to satisfy his sexual desires. He is said to have approached the victim from behind, removed her pyjama trousers and underwear. When the victim woke up, he allegedly used force to restrain her and proceeded to sexually assault her. Despite her pleas for him to stop, he reportedly ignored her.
Aftermath and Legal Proceedings
The victim has been receiving psychological treatment following the incident. The prosecutor is also seeking compensation for moral damages for the victim, the amount of which will be determined in the sentence if the accused is convicted. The trial is set to take place this month in Malaga, where the accused will face a potential ten-year prison sentence for sexual assault. Additionally, a 12-year restraining order could be imposed, prohibiting the accused from coming within 500 metres of the victim.
